E-Pass Re-Targets Microsoft & Compaq
E-pass has filed a motion in the United States District Court in Houston, Texas, to resume its patent infringement litigation against Microsoft and Compaq. The motion was filed in light of the recent E-pass victory in the United States Court of Appeals for the Federal Circuit in the E-pass infringement action against Palm & 3com. The appeal concerned the scope of the E-pass patent. Although the Federal Circuit decision was in an appeal from the U.S. District Court in California, that decision is binding on all U.S. District Courts. The E-pass motion to resume the Microsoft patent infringement litigation is being vigorously opposed by Microsoft's and Compaq's attorney, Michael Sutton, of Houston, Texas.
